Jensen Law Professional Corporation (“Jensen Law P.C.”) recognizes the importance of privacy and the sensitivity of personal information. The firm has the professional obligation to keep confidential all information Jensen Law P.C. receives within a lawyer-client relationship. Jensen Law P.C. is committed to protecting any personal information held by the firm. This Privacy Policy outlines how the firm manages your personal information and safeguards your privacy.
Your Privacy Rights
From January 1, 2004, all businesses engaged in commercial activities must comply with the Personal Information Protection and Electronic Documents Act. These obligations extend to lawyers and law firms, including Jensen Law P.C. The Act gives you rights concerning the privacy of your personal information.
Jensen Law P.C. is responsible for the personal information the firm collects and holds. To ensure this accountability, the firm has developed this policy, to explain Jensen Law P.C.’s privacy policies and practices.
Why Does Jensen Law P.C. Need Personal Information?
Jensen Law P.C. provides legal services and products to a wide range of clients. In doing so, the firm also produces direct marketing materials concerning its services and developments in the law.
What Personal Information Does Jensen Law P.C. Collect?
Personal Information is any information that identifies you, or by which your identity could be deduced.
If Jensen Law P.C. did not collect and use your personal information, the firm could not provide you with legal services.
How Does Jensen Law P.C. Collect Your Personal Information?
Jensen Law P.C. collects information only by lawful and fair means, and not in an unreasonably intrusive way. Wherever possible, Jensen Law P.C. collects your personal information directly from you, both at the start of a retainer and in the course of the firm’s representation.
Sometimes Jensen Law P.C. may obtain information about you from other sources, for example:
- Your insurance company;
- From a government agency or registry;
- Your employer, if the firm is acting for you, at its request;
- Your accountant.
Consent
In most cases, Jensen Law P.C. shall ask you to specifically consent, if the firm collects, uses or discloses your personal information. Normally, Jensen Law P.C. asks for your consent in writing, but in some circumstances, the firm may accept your oral consent. Sometimes, your consent may be implied through your conduct with the firm.
Use of Your Personal Information
Jensen Law P.C. uses your personal information to provide legal advice and services to you, for administrative purposes, to include you in any direct marketing activities, and to engage with our third party service providers. If you tell the firm that you no longer wish to receive information about the firm’s services, or about new developments in the law, Jensen Law P.C. will not send any further material.
Jensen Law P.C. does not disclose your personal information to any third party to enable them to market their products or services. For example, the firm does not provide client mailing lists to other law firms.
Disclosure of Your Personal Information
Under certain circumstances, Jensen Law P.C. will disclose your personal information:
- When the firm is required or authorized by law to do so, for example if a court issues a subpoena;
- When you have consented to the disclosure;
- When the legal services Jensen Law P.C. is providing to you requires the firm to give your information to third parties, your consent will be implied, unless you tell the firm otherwise;
- Where it is necessary to establish or collect fees;
- If Jensen Law P.C. engages a third party to provide administrative services (like computer back-up services or archival file storage) and the third party is bound by obligations of confidentiality;
- If the firm retains other law firms at your request, and on your behalf;
- If the personal information is Publicly Available Personal Information, as it is defined under the Personal Information Protection and Electronic Documents Act.
Updating Your Personal Information
Since Jensen Law P.C. uses your personal information to provide legal services to you, it is important that the information be accurate and up-to-date.
If during the course of the retainer, any of your information changes, please inform Jensen Law P.C., so that the firm can make any necessary changes.
Is Your Personal Information Secure?
Jensen Law P.C. takes all reasonable precautions to ensure that your personal information is kept safe from loss, unauthorized access, modification or disclosure. Among the steps taken to protect your information are:
- Premises security;
- Restricted file access to personal information;
- Technological safeguards like security software and firewalls to prevent hacking or unauthorized computer access;
- Internal password and securities policies.
Access to Your Personal Information
You may ask for access to any personal information Jensen Law P.C. holds about you.
Summary information is available on request. More detailed requests which require archive or other retrieval costs may be subject to the firm’s normal professional and disbursement fees.
Correcting Errors
If Jensen Law P.C. holds information about you and you can establish that it is not accurate, complete and up-to-date, the firm will take reasonable steps to correct it.
Can You Be Denied Access to Your Personal Information?
Your rights to access your personal information are not absolute. Jensen Law P.C. may deny access when:
- It is required or authorized by law (for example, when a record containing personal information about you is protected by solicitor-client privilege);
- To do so would reveal confidential commercial information, and the personal information cannot be severed from the record);
- To do so could reasonably be expected to threaten the life or security of another individual, and the personal information cannot be severed from the record; or
- The information was generated in the course of a formal dispute resolution process.
If Jensen Law P.C. denies your request for access to, or refuse a request to correct information, the firm shall explain why.
Communicating With Jensen Law P.C.
You should be aware that e-mail is not a 100% secure medium, and you should be aware of this when contacting Jensen Law P.C. to send personal or confidential information.
Changes to This Privacy Policy
Since Jensen Law P.C. regularly reviews all of its policies and procedures, the firm may change this Privacy Policy from time to time, without notice.
